1. About these Terms

These Terms and Conditions (the "Terms") are a binding agreement between you and DILDO DATING PRIVATE LIMITED, a private limited company incorporated in India ("The Creator Pass", "we", "us"), which operates The Creator Pass website, mobile apps and related services (together, the "Platform"). They apply to everyone who uses the Platform, whether as a creator, a member, or a visitor. By creating an account or using the Platform, you agree to these Terms, our Privacy Policy, and any community, content and payment guidelines we publish, which are incorporated by reference. If you do not agree, please do not use the Platform.

3. Eligibility and verification

The Platform is strictly for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally able to enter into a contract. Before earning or receiving payouts, creators must complete identity and age verification (KYC), and may be asked to re-verify from time to time. We may refuse, restrict or revoke access if we cannot verify your identity or age, or where required by law. You may hold only one account unless we agree otherwise in writing.

4. Your account

You are responsible for the accuracy of the information you give us and for keeping your login credentials confidential. You are responsible for all activity that happens under your account. Tell us promptly at info@thecreatorpass.com if you suspect any unauthorised use. Payments are handled by third-party payment processors, and your use of those services is also subject to their own terms.

5. Creators on the Platform

Creators can offer memberships and tiers, exclusive posts, pay-per-view unlocks, private chat, scheduled 1:1 voice and video calls, live streams, tips and gifts, and custom paid requests. When you publish, you are responsible for the content you share, for holding all necessary rights and consents (including documented proof of age and consent for every identifiable person featured), and for classifying and pricing your offerings honestly. You grant The Creator Pass the licence described in Section 11 so we can host and deliver your content to your members.

6. Members on the Platform

When you buy a membership, unlock, call, request or other offering, you receive a personal, limited, non-transferable licence to access that content or service for your own private, non-commercial use. You may not copy, screen-record, download (except where a feature explicitly allows it), resell, publish or redistribute any creator content. Doing so may breach these Terms and the creator's intellectual-property rights and applicable law.

7. Fees, payments, taxes and payouts

Creators set their own prices, which are shown to members before purchase. The Creator Pass charges a platform fee on creator earnings, disclosed in the app before you start earning. Taxes are applied as required by Indian law, including Goods and Services Tax (GST) on platform service fees, and tax collected or deducted at source on creator earnings where applicable, such as TDS under Section 194-O of the Income-tax Act, 1961. Creators are responsible for their own tax registration and filings. Verified creator earnings are paid out to a verified UPI ID or bank account on the schedule shown in the app, net of platform fees, applicable taxes, refunds and chargebacks. Funds for custom paid requests may be held in escrow until the work is delivered or the order is closed.

8. Accessing the Platform

You need a compatible device, a supported browser or app version, and an internet connection to use the Platform. Certain features may require you to grant permissions (such as camera, microphone or notifications). We may release updates automatically and may add, change or remove features. We aim to keep the Platform available but do not guarantee uninterrupted or error-free access.

You agree not to use the Platform to, and not to allow anyone else to:

10. Reporting, moderation and takedowns

We operate content-moderation and reporting tools and act as an intermediary under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. If you believe content infringes your rights or these Terms, contact our Grievance Officer (Section 18). We follow a notice-and-action process, allow good-faith counter-notices, and may disable or remove content and terminate repeat infringers. We may also remove content or restrict accounts to comply with a court order or a lawful government request.

11. Content ownership and licence

Creators keep ownership of the content they upload. By publishing on the Platform, a creator grants The Creator Pass a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt (for formatting), and display that content solely to operate, secure and promote the Platform and to deliver it to intended members. This licence ends when the content is removed, except for copies retained to meet legal obligations or already delivered to members. You grant us a perpetual, royalty-free licence to use any feedback or suggestions you share, without obligation to you.

12. Refunds and cancellations

Because most purchases immediately unlock digital content or reserve a creator's time, all purchases are non-refundable, except in the limited situations set out in our Cancellation and Refund Policy, which forms part of these Terms, and except as required by the Consumer Protection Act, 2019 and other applicable law. You can cancel a recurring membership at any time, with effect from the end of the current billing period; you keep access until then. Abusive or fraudulent chargebacks may lead to account suspension.

13. Our intellectual property

The Platform's software, branding, logos, design and other materials are owned by The Creator Pass and its licensors and are protected by law. Nothing in these Terms transfers those rights to you. You may not use our marks without our prior written permission.

14. Disclaimers

The Platform is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including any warranty of accuracy, reliability, security, or fitness for a particular purpose. The Creator Pass is a neutral venue and payments facilitator; the contract for any content or service is between the creator and the member, and we do not endorse or guarantee any creator, member or content.

15. Limitation of liability

To the maximum extent permitted by law, The Creator Pass is not liable for any indirect, incidental, special, consequential or punitive losses, or for loss of profit, data, goodwill or business, arising from your use of the Platform. Where liability cannot be excluded, our total aggregate liability to you is limited to the total fees you paid to us in the three months before the event giving rise to the claim.

16. Indemnity

You agree to defend, indemnify and hold harmless The Creator Pass and its officers, employees and partners from any claims, damages, losses and costs (including reasonable legal fees) arising out of your content, your use of the Platform, or your breach of these Terms or of any law or third-party right.

17. Suspension and termination

You may stop using the Platform and close your account at any time. We may suspend, restrict or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Platform, its users or the public. On termination, your right to use the Platform ends; provisions that by their nature should survive — including those on payments owed, content licences already delivered, intellectual property, disclaimers, liability, indemnity and governing law — continue to apply.

18. Grievance redressal

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer for complaints about content or the Platform. You can reach our Grievance Officer at info@thecreatorpass.com. We will acknowledge a complaint within 24 hours and aim to resolve it within 15 days of receipt.

19. Governing law and disputes

These Terms are governed by the laws of India, and the Platform operates in accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, and the Prevention of Money-Laundering Act, 2002, among other applicable laws. The parties will first try to resolve any dispute amicably; failing that, disputes are subject to the exclusive jurisdiction of the courts having jurisdiction over our registered office in India.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email before they take effect. Continuing to use the Platform after changes take effect means you accept the updated Terms.

21. General

These Terms, together with the policies referenced in them, are the entire agreement between you and us about the Platform. If any provision is found unenforceable, the rest remain in force. Our failure to enforce a right is not a waiver of it. You may not assign your rights without our consent; we may assign ours to a successor. Nothing here creates a partnership, agency or employment relationship between you and us. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure).
